These general terms of use (hereinafter referred to as “GTU”) aim to legally frame the conditions under which DXND provides access to its “Sites” (www.dxnd.fr, shop.douxniddeco.fr, or shop.madeinaspiran.fr) and related services, as well as the terms of access and use by the “User.”

The present GTU can be accessed on the Sites under the “General Terms of Use” or “GTU” section.

Any registration or use of the Sites implies full acceptance of these GTU by the User without any reservations or restrictions. Upon registration on the Sites via the registration form, each User explicitly accepts these GTU by ticking the box preceding the following text: “I acknowledge that I have read and understood the GTU and I accept them.”

If the User does not accept the GTU outlined in this document, they must refrain from accessing the services offered by the Sites.

DXND reserves the right to unilaterally modify the content of these GTU at any time.

The Sites are published by SAS DXND, a company with a share capital of €5,000, registered with the Montpellier Trade and Companies Register under number 932829914, and whose headquarters is located at 7 rue de la Chapelle, 34800 Aspiran.

ARTICLE 2: Access to the Sites

The websites provide the following services:

  • General information and blog (www.dxnd.fr)
  • Online sales (shop.douxniddeco.fr, shop.madeinaspiran.fr)

The Sites are freely accessible from any location to any User with internet access. All costs incurred by the User to access the service (computer hardware, software, internet connection, etc.) are their responsibility.

Non-registered Users do not have access to reserved services. To gain access, the User must register by completing the form. By agreeing to register for the reserved services, the registered User agrees to provide sincere and accurate information regarding their identity and contact details, particularly their email address.

To access the services, the User must log in using the identifier and password provided to them upon registration.

Any registered User may request account deletion by visiting the dedicated page within their personal space. This deletion will take effect within a reasonable period.

DXND cannot be held responsible for service disruptions caused by force majeure, maintenance, or technical malfunctions of the site or server. In such cases, the User agrees not to hold the publisher liable for any interruptions or suspensions of service, even without prior notice.

ARTICLE 3: Data Collection

The Sites ensure the collection and processing of personal information in compliance with privacy laws, particularly the French Data Protection Act (law n°78-17 of January 6, 1978).

Under the Data Protection Act, the User has the right to access, rectify, delete, and oppose their personal data. This right can be exercised by emailing info@dxnd.fr.

ARTICLE 4: Intellectual Property

The trademarks, logos, signs, and all contents of the Sites (text, images, sound, etc.) are protected by the French Intellectual Property Code, particularly copyright law.

The User must obtain prior authorization from the Sites for any reproduction, publication, or copying of its content. The User agrees to use the contents of the Sites strictly for personal purposes, as any commercial or advertising use is strictly prohibited.

Any total or partial representation of these Sites by any means without the explicit authorization of the publisher constitutes an infringement punishable under articles L 335-2 and following of the Intellectual Property Code.

In accordance with article L122-5 of the Intellectual Property Code, the User who reproduces, copies, or publishes protected content must credit the author and source.

ARTICLE 5: Liability

The sources of the information provided on the Sites are considered reliable, but the Sites do not guarantee freedom from defects, errors, or omissions.

The information provided is general and for informational purposes, without contractual value. Despite regular updates, the Sites cannot be held responsible for administrative or legal changes after publication. Similarly, the Sites cannot be held responsible for the use or interpretation of the information contained within.

The User is responsible for keeping their password confidential. Any password disclosure, regardless of its form, is prohibited. The User assumes the risks associated with the use of their identifier and password. DXND declines all responsibility.

DXND cannot be held liable for viruses that may infect the User’s computer or hardware as a result of using, accessing, or downloading from the Sites.

DXND’s liability cannot be engaged in cases of force majeure or unforeseeable and insurmountable actions by a third party.

ARTICLE 6: Hypertext Links

Hypertext links may be present on the Sites. By clicking on these links, the User is leaving the Sites. DXND has no control over these external pages and cannot be held responsible for their content.

ARTICLE 7: Cookies

The User is informed that cookies may be automatically installed on their browser during visits to the Sites.

Cookies are small files temporarily stored on the User’s computer via the browser and are necessary for the use of the Sites. Cookies are anonymous and do not contain personal information. Some cookies expire at the end of the User’s session, while others persist.

The information in cookies is used to improve the Sites. By navigating the Sites, the User agrees to their use.

The User can disable cookies through their browser settings.

ARTICLE 8: Governing Law and Jurisdiction

French law governs these GTU. In the event of unresolved disputes, French courts have exclusive jurisdiction.

These GTU are written in French. If translated into one or more foreign languages, only the French version prevails in the event of a dispute.
